By accessing or using the Winbig9ja platform, creating an account, or purchasing any Entry, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Platform.
1. Definitions
- "Winbig9ja", "we", "us", or "our" refers to Winbig9ja Limited, a company registered in Nigeria (RC No. 1234567), operating a regulated property draw service licensed by the National Lottery Regulatory Commission (NLRC).
- "Platform" means the website at winbig9ja.com and any associated mobile applications.
- "Draw" refers to any individual house draw listed and operated on the Platform.
- "Entry" or "Entries" means one or more tickets purchased by a Participant for a specific Draw.
- "Participant" means any individual who has registered on the Platform and purchased at least one Entry.
- "Winner" means the Participant whose Entry Reference Number is selected in a valid Draw.
2. Eligibility
- You must be at least 18 years of age to register and participate in any Draw.
- You must be a resident of the Federal Republic of Nigeria or a Nigerian citizen, unless expressly permitted in writing by Winbig9ja.
- Employees of Winbig9ja Limited, members of their immediate families, and any independent auditor engaged for a specific Draw are not eligible to participate in that Draw.
- Winbig9ja reserves the right to request proof of identity and eligibility at any time. Failure to provide satisfactory proof may result in disqualification and forfeiture of any prize.
- By creating an account, you confirm that all information you provide is truthful, accurate, and up to date.
3. Entry Purchase & Payment
- Entries may only be purchased through the Platform using approved payment methods: card (Mastercard, Visa, Verve), bank transfer, or USSD as displayed at checkout.
- All prices are stated in Nigerian Naira (NGN). The price per Entry is fixed at the time of purchase and will not change after payment is confirmed.
- Entry purchases are final and non-refundable except in the circumstances described in Section 5 (Uncompleted Draws).
- Upon successful payment, you will receive a unique Entry Reference Number by email and SMS. This reference number is your sole proof of participation. Winbig9ja is not liable for entries lost due to incorrect contact details provided by the Participant.
- Entries are personal and non-transferable. They may not be sold, gifted, or otherwise assigned to another person.
- Winbig9ja reserves the right to reject or void any purchase where fraudulent payment activity is suspected, in compliance with applicable anti-money laundering regulations.
4. Draw Conduct
- A Draw is only conducted after 100% of available Entries for that Draw have been sold. No Draw will proceed with unsold entries.
- The draw date is set by Winbig9ja and will be announced to all Participants by email at least 72 hours in advance.
- All Draws are conducted live on Winbig9ja's official Instagram and YouTube channels, witnessed by an independent chartered accountant and a notary public.
- Winners are selected using a certified random number generator (RNG) operated by the independent auditor. The output is recorded, signed, and archived.
- The winning Entry Reference Number will be published on the Platform, on social media, and communicated directly to the Winner within 1 hour of the Draw.
- Winbig9ja's decision on Draw results is final and binding, subject only to an independent audit process if formally disputed within 14 days of the Draw.
5. Uncompleted Draws & Refunds
- If a Draw fails to sell all available Entries within 90 calendar days of the Draw's launch date, the Draw will be cancelled.
- In the event of cancellation, all Participants will receive a full refund of the purchase price of their Entries within 5 business days to the original payment method.
- Winbig9ja reserves the right to extend a Draw's availability period beyond 90 days by notifying all current Entry holders by email. Participants may request a refund within 7 days of receiving such notice if they do not wish to continue.
- Winbig9ja is not liable for any consequential loss, opportunity cost, or interest on refunded amounts.
6. Prizes & Title Transfer
- The prize for each Draw is the property described in the Draw listing. Property valuations are conducted by an independent RICS-qualified surveyor.
- Winbig9ja will cover all legal costs and stamp duty associated with the transfer of title to the Winner.
- Prize taxes, including any capital gains or lottery prize taxes, will be settled by Winbig9ja on behalf of the Winner. Winners will not bear any tax liability in respect of their prize.
- The Winner will be contacted by a Winbig9ja legal representative within 24 hours of the Draw to begin the title transfer process.
- The title transfer process typically takes 30 to 60 business days, subject to regulatory processes at the relevant land registry.
- If a Winner cannot be reached or fails to complete identity verification within 30 days of notification, the prize will be held in escrow for a further 6 months. After this period, Winbig9ja may conduct a redraw or donate the prize to a registered Nigerian charity.
7. Participant Conduct
- Participants must not use the Platform for any unlawful purpose, including money laundering, fraud, or financing of illegal activities.
- Multiple accounts registered to the same individual are prohibited. Winbig9ja reserves the right to cancel all entries and withhold prizes from any Participant found operating duplicate accounts.
- Any attempt to manipulate, hack, or compromise the integrity of any Draw or the Platform's systems will result in immediate disqualification and may be referred to law enforcement.
- Participants agree not to post false, misleading, or defamatory content about Winbig9ja, its employees, or its partners on any public platform.
8. Limitation of Liability
- Winbig9ja's total liability to any Participant arising out of or in connection with the Platform shall not exceed the total amount paid by that Participant in the 12 months preceding the event giving rise to the claim.
- Winbig9ja is not liable for any indirect, consequential, special, or punitive damages, including loss of profit or data.
- Winbig9ja is not responsible for third-party payment processor errors or delays.
- Nothing in these Terms limits Winbig9ja's liability for death, personal injury caused by negligence, or fraud.
9. Changes to These Terms
- Winbig9ja may update these Terms at any time. Material changes will be communicated by email and by a notice on the Platform at least 14 days before taking effect.
- Continued use of the Platform after the effective date of any update constitutes acceptance of the revised Terms.
10. Governing Law
- These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
- Any dispute arising from these Terms shall first be referred to mediation under the Lagos Court of Arbitration rules. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Lagos State.
